1. INTRODUCTION

These Terms and Conditions ("Terms") govern your access to and use of the Habibi Rizz mobile application (the "App") operated by Habibi Rizz ("we," "our," or "us").

By downloading, installing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.

2. DEFINITIONS

"App" refers to the Habibi Rizz mobile application.

"User," "you," and "your" refer to the individual accessing or using the App.

"Content" refers to text, images, audio, video, and all other forms of data or communication.

"User Content" refers to Content that users submit or transmit to, through, or in connection with the App.

3. USE OF THE APP

3.1 Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years old and that your use of the App does not violate any applicable law or regulation.

3.2 App License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download and install a copy of the App on a mobile device that you own or control and to run such copy of the App solely for your personal, non-commercial purposes.

3.3 Restrictions

You may not:

- Copy, modify, or create derivative works based on the App

- Distribute, transfer, sublicense, lease, lend, or rent the App to any third party

- Reverse engineer, decompile, or disassemble the App

- Make the App available over a network where it could be used by multiple devices at the same time

- Remove, alter, or obscure any proprietary notice on the App

- Use the App for any illegal purpose or in violation of any local, state, national, or international law

4. USER ACCOUNTS

4.1 Account Creation

To use certain features of the App, you may need to create an account. When creating an account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

5. SUBSCRIPTION AND PAYMENTS

5.1 Free Trial

We may offer a free trial period for new users. After the trial period ends, you will need to purchase a subscription to continue using premium features.

5.2 Subscription Plans

We offer subscription plans that provide access to premium features. The specific features, pricing, and billing cycle for each subscription plan are described in the App at the time of purchase.

5.3 Payment Processing

Subscriptions are billed through your App Store or Google Play account. Payment will be charged to your account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

5.4 Cancellation

You can cancel your subscription at any time through your App Store or Google Play account settings. Cancellation will take effect at the end of the current billing period.

5.5 Refunds

Refunds are handled by the App Store or Google Play Store according to their policies. We do not process refunds directly.

6. USER CONTENT

6.1 Content Responsibility

You are solely responsible for any User Content you submit to the App. You represent and warrant that:

- You own or have the necessary rights to use and authorize us to use all intellectual property rights in and to any User Content

- Your User Content does not violate the rights of any third party

- Your User Content complies with these Terms and all applicable laws

6.2 Content License

By submitting User Content to the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the App and our business operations.

6.3 Content Monitoring

We do not control or monitor User Content and do not guarantee the accuracy, integrity, or quality of such content. However, we reserve the right to review, screen, and delete any User Content at any time and for any reason.

7. PROHIBITED CONDUCT

You agree not to:

- Use the App for any illegal purpose or in violation of any local, state, national, or international law

- Harass, abuse, or harm another person

- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity

- Interfere with or disrupt the App or servers or networks connected to the App

- Attempt to gain unauthorized access to any portion of the App or any other accounts, computer systems, or networks connected to the App

- Use any robot, spider, site search/retrieval application, or other automated device, process, or means to access, retrieve, scrape, or index any portion of the App

- Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful

8. INTELLECTUAL PROPERTY

8.1 App Content

The App and its original content, features, and functionality are owned by Habibi Rizz and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8.2 Trademarks

The Habibi Rizz name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Habibi Rizz or its affiliates. You may not use such marks without our prior written permission.

9. DISCLAIMERS

9.1 App Availability

We do not guarantee that the App will always be available, uninterrupted, timely, secure, or error-free.

9.2 Content Accuracy

We make no warranties or representations about the accuracy or completeness of the App's content or the content of any websites linked to the App.

9.3 General Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HABIBI RIZZ, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

- YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP

- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP

- ANY CONTENT OBTAINED FROM THE APP

- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Habibi Rizz, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

12. TERMINATION

12.1 Termination by You

You may terminate your account at any time by discontinuing use of the App and deleting it from your device.

12.2 Termination by Us

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

12.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

14. CHANGES TO TERMS

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
